TERMS AND CONDITIONS OF SALE (T&Cs) – MAÏYA PARIS

I – Preamble

Scope These Terms and Conditions apply to the website www.maiyaparis.com. The delivery "Territory" includes France, the European Union, the USA, Switzerland, French Overseas Territories, and the Rest of the World (depending on the options available at checkout). MAÏYA reserves the right to modify the list of deliverable countries at any time.

The Customer The Online Store is reserved for non-professional customers (consumers), aged 18 or over. Sales are for strictly personal use only.

II – Ordering

The ordering process involves product selection, cart validation, customer identification, and explicit acceptance of these T&Cs before payment. An order confirmation email is sent immediately after payment validation.

III – Payment

Payment is made by credit card (Visa, Mastercard, Amex), Apple Pay, Klarna, or PayPal via the secure platforms Shopify Payments and PayPal.

IV – Delivery and Receipt of Products

Terms and Timelines The total delivery time includes preparation time (up to 48 hours, and up to 5 business days during peak periods) plus shipping transit time. Pre-orders are shipped within 2 to 4 weeks. All deliveries require a signature upon receipt.

Shipping Fees Shipping fees are calculated based on the destination and the shipping method. The exact amount is shown to the Customer before final validation of the order. Free shipping thresholds may apply (e.g., free for France and the EU on orders over €300).

Receipt and Damage The Customer must check the condition of the package upon delivery. In the event of a damaged product, the Customer must contact Customer Service (hello@maiyaparis.com) on the day of delivery, including photos of the packaging and the item.

V – Right of Withdrawal and Returns

Right of Withdrawal In accordance with the law, the Customer has 14 calendar days from receipt of the order to exercise their right of withdrawal.

Return Conditions Items must be returned in new, unworn, unwashed, and unaltered condition, in their original packaging.

  • Hygiene: For swimwear, the hygienic sticker must be intact. Any item where the sticker has been removed, moved, or damaged will be refused.

  • Return Fees: Return shipping costs are the responsibility of the Customer. As an exception, MAÏYA covers return shipping for size or style exchanges within Metropolitan France only.

  • Customs (Non-EU): For returns from outside the European Union, any taxes and customs duties related to the re-entry of the package into France are the exclusive responsibility of the Customer and will be deducted from the final refund.

Exchanges and Refunds

  • Within 14 days: Refund or exchange available.

  • From 15 to 30 days: Exchange or store credit only (valid for 1 year). Refunds are processed within 14 days after receipt and inspection of the product.

VI – Liability

MAÏYA cannot be held responsible for the loss or non-receipt of packages due to international carriers or cases of force majeure. Once the package is handed over to the carrier, MAÏYA is no longer responsible for delivery delays or incidents.

VII – Legal Warranties

The Customer benefits from the legal warranty of conformity (2 years) and the warranty against hidden defects. In the event of a proven defect, MAÏYA will proceed with the repair, replacement, or refund of the item.

VIII – Intellectual Property

All elements of the site (logos, designs, photos, texts) are the exclusive property of MAÏYA. Any reproduction, even partial, is strictly prohibited.

IX – Applicable Law / Disputes

These T&Cs are subject to French law. In the event of a dispute, an amicable solution will be sought. Failing that, French courts shall have exclusive jurisdiction.
